After a Car Accident, Will Minnesota No-Fault Insurance Cover Your Damages?

As a no-fault state for car accidents, Minnesota requires drivers to have minimum insurance coverage. Your policy must include $40,000 of personal injury protection coverage, or PIP, per covered individual. That amount includes $20,000 for medical bills and $20,000 for non-medical expenses, such as lost wages and recovery-related costs. If you are injured in a car accident, you must first turn to your PIP coverage for your medical bills and lost wages.

PIP insurance does not cover the following damages:

  • Property damage
  • Injury to non-covered individuals
  • Pain and suffering
  • Other non-economic losses
  • Medical and related costs above the policy limit

Minnesota also requires drivers to have the following coverage:

  • Uninsured motorist coverage: $25,000 per person and up to $50,000 per accident if more than one person suffers injuries
  • Underinsured motorist coverage: $25,000 per person or up to $50,000 per accident
  • Fault-based liability insurance: $30,000 per person for bodily injury, up to $60,000 per accident

These coverage types come into play when one driver is at fault for the accident. If your PIP insurance does not cover your losses and another driver is at fault, you might be eligible to file a claim against them. You can pursue a claim against an at-fault driver if you meet the following criteria:

  • You have at least $4,000 in medical bills.
  • You suffer a disability, permanent injury, or disfigurement that lasted at least 60 days.

If the other driver does not have sufficient insurance, you can pursue a claim under your uninsured or underinsured coverage.

Minnesota follows modified comparative negligence laws, which means you may be able to recover damages if your degree of fault is less than the defendant’s.

If you are 50 percent or less responsible, you can recover damages. However, your compensation will be reduced in proportion to your share of the fault. For example, if you are 30 percent at fault, you can collect 70 percent of your damages.

While you have no legal obligation to secure a police report after an accident, having one is important if you file a claim. Insurance companies often rely on them when assessing claims. They also can lead to valuable evidence that can be used in court to prove your case.

Most car insurance settlements are not taxable income in Minnesota, with select exceptions. However, compensation for lost wages is taxable because it replaces taxable working income. Most punitive damages are also taxable.

Because Minnesota is a no-fault insurance state, your insurance policy pays your medical bills regardless of fault. If your bills exceed your coverage and another driver is at fault, you can pursue a claim against the at-fault driver. The driver’s insurance company will cover the driver’s liability up to the policy limits.
